What “As-Is” Really Means in Texas Real Estate

At NuLuxe Realty Group, one of the biggest misconceptions we see among homebuyers is the meaning of an “as-is” contract.

Many buyers assume “as-is” means:

  • the seller owes them nothing,

  • the property comes with no protections,

  • and once the contract is signed, the buyer is stuck regardless of what inspections uncover later.

That is not entirely true.

In Texas real estate, an as-is addendum typically means the seller is not agreeing to make repairs or renegotiate based on inspection findings. However, sellers may still have legal obligations to disclose known material defects that could affect the value or safety of the property.

An as-is contract does not waive fraud or intentional concealment.

Why This Matters for Buyers

In competitive Dallas-Fort Worth and Houston real estate markets, buyers often feel pressure to:

  • waive repair negotiations,

  • shorten option periods,

  • or move quickly to secure a property.

But many buyers do not fully understand the financial risk they are assuming.

A home can look beautifully renovated while still hiding:

  • foundation movement,

  • plumbing leaks,

  • roof problems,

  • electrical hazards,

  • or drainage issues.

That is why inspections remain critical even in as-is transactions.
